1. Nature of the Software & Non-Advisory Status
ApexTrader OS (operated by its parent entity, developers, and licensors, collectively referred to as "the Platform", "we", "us", or "our") is strictly a technological, educational, and quantitative analytical software suite. The Platform provides tools such as trade journaling logs, multi-timeframe chart layouts, position size calculators, Monte Carlo drawdown simulations, session timers, and peer discussion spaces.
ApexTrader OS is NOT a registered investment advisor (RIA), commodity trading advisor (CTA), broker-dealer, financial planner, or custodian. We do not provide personalized investment advice, financial planning, portfolio management, or trade execution services. Any data, signals, statistical metrics, or educational content generated by or hosted on the Platform are for educational, research, and self-evaluative purposes only.
2. CFTC Rule 4.41 — Hypothetical Performance Disclaimer
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
Any performance analytics, historical win rates, R-multiple projections, or Monte Carlo distributions displayed within the ApexTrader OS journal, radar, or calculator represent mathematical models and user-input records. They do not constitute a guarantee, promise, or projection of actual future trading performance.
3. Leverage and Volatility Risk
Trading off-exchange leveraged products such as Forex, Index Futures, and CFDs involves significant market volatility. While leverage allows traders to control larger contract sizes with minimal initial margin, it magnifies both profits and losses equally:
- Margin Call Risk: An adverse price movement may require you to deposit additional funds immediately. Failure to meet margin requirements will result in your broker liquidating open positions at a total loss.
- Negative Balance Exposure: Depending on broker terms and regulatory jurisdiction, market gaps or extreme black-swan volatility can result in losses exceeding your deposited capital.
- Stop-Loss Slippage: Stop-loss orders do not guarantee execution at your specified price during market openings, macroeconomic news releases (e.g., NFP, CPI, FOMC), or illiquid periods. Execution will occur at the next available market price (slippage).
4. Signals, Killzone Radar & Market Bias Disclaimer
Any trade ideas, technical setups, killzone countdowns, or market direction biases shared within ApexTrader OS, its live chat rooms, or its notification systems reflect technical opinions and mathematical criteria:
- They must never be construed as an invitation, recommendation, or solicitation to buy or sell any financial instrument.
- You are solely responsible for conducting independent market analysis and deciding whether a trade aligns with your personal risk tolerance.
- Past accuracy or historical signal records provided by community members or platform administrators are no indicator of future trade outcomes.
5. Technical & Electronic Execution Risks
Operating software and trading over internet infrastructure involves inherent technological risks beyond our control:
- Hardware and Connectivity Failures: Network outages, ISP disconnections, device malfunctions, or latency spikes can prevent timely transmission of trade data or alerts.
- Third-Party Feed Discrepancies: Market price feeds, session clocks, and charting widgets rely on third-party data providers. We do not warrant the continuous accuracy, completeness, or uninterrupted delivery of external market data.
- Browser Compatibility & Storage: Local calculations and cached trade entries may be affected by browser settings, cookie clearing, or local database corruption. Users are encouraged to maintain independent offline trade backups.
6. No Guarantees of Profit or Capital Preservation
Statistics published by major financial regulatory authorities (including the US CFTC, UK FCA, and EU ESMA) consistently demonstrate that between 70% and 89% of retail investor accounts lose money when trading CFDs, Forex, and leveraged derivatives.
ApexTrader OS does not promise, warrant, or guarantee that using our software will generate profits, reduce trading losses, prevent psychological mistakes, or ensure commercial trading success. You trade entirely at your own discretion and risk.
7. Acknowledgment & Inquiries
By creating an account, subscribing to, or accessing any module of ApexTrader OS, you explicitly acknowledge that you have read, understood, and agreed to this Risk Disclosure Statement in its entirety.
