1. Acceptance of Terms
These Terms of Service (the "Agreement") govern your access to and use of ApexTrader OS (the "Service", "Software", or "Platform"), including all web applications, local server instances, documentation, and communication floors. By purchasing a subscription, registering an account, or downloading any software component, you agree to be bound by these terms. If you do not agree to these terms, you must not access or use the Platform.
2. Permitted Use & License Grant
Subject to continuous compliance with this Agreement and timely payment of subscription fees, ApexTrader OS grants you a non-exclusive, non-transferable, revocable, single-user license to access and use the software for personal, non-commercial trading analysis and journaling.
License Restrictions: You shall not:
- Sub-license, resell, lease, distribute, or time-share your account credentials or software access.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of proprietary client or server routines.
- Deploy automated scrapers, web spiders, bots, or data harvesting scripts on the platform.
- Circumvent or tamper with session authentication, licensing validation checks, or role-based access control.
3. Subscription Plans, Billing & Renewals
ApexTrader OS offers transparent subscription tiers as detailed on our official pricing schedule:

Recurring Renewals: Monthly and Annual plans automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. Payments are securely processed via third-party processors (including PayPal). We never store your full credit card number or bank details on our servers.
Cancellation Policy: You may cancel recurring billing at any time with one click through your platform settings or directly within your PayPal subscription dashboard. Upon cancellation, your access remains fully active until the end of your prepaid billing period.

If ApexTrader OS does not meet your expectations, simply email support@apextrader.bond within 14 days of your initial purchase with your order transaction ID, and our billing desk will issue a 100% refund promptly. Lifetime licenses are eligible for refunds within 7 days of purchase.
5. User Account Integrity & Security
You are solely responsible for maintaining the confidentiality of your account login credentials, cryptographic password hashes, and session cookies. You agree to notify us immediately of any unauthorized use or security breach. ApexTrader OS cannot and will not be liable for any loss or damage arising from your failure to safeguard your account.
6. Community Floor Conduct & Content Moderation
Our community floor and live chat modules are designed for disciplined, professional traders. To maintain a safe, spam-free environment, you agree not to:
- Promote unverified financial signals, affiliate referral links, signal Telegrams, or unauthorized commercial services.
- Post vulgar, harassing, defamatory, abusive, racist, or threatening messages.
- Attempt to sell account passing services or solicit funds from other members.
We employ automated keyword rate limiting and human admin moderation. Violation of community standards may result in immediate temporary suspension or permanent termination of chat privileges without refund.
7. Disclaimer of Warranties ("AS IS")
THE PLATFORM AND ALL INCLUDED MATERIALS, DATA, ALARMS, CALCULATORS, AND METRICS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXTRADER OS DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE JURISDICTION, IN NO EVENT SHALL APEXTRADER OS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF TRADING CAPITAL, MARGIN LIQUIDATIONS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.
IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY YOU TO APEXTRADER OS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
9. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law principles. Any dispute or controversy arising out of this Agreement shall be settled through good-faith informal negotiations, or if unresolved, through binding confidential arbitration.
